Working Artists and the Greater Economy, Inc. (“we,” “us,” “our”) respect(s) and protect(s) the privacy of Users (“WAGENTS,” “you,” “your” ) on WAGENCY.

This policy explains what you can expect from us and what we need from you in relation to your personal data. Please read this carefully as this policy is legally binding when you use WAGENCY. ACCEPTANCE OF PRIVACY POLICY

By accessing and using WAGENCY, you accept the terms of this Privacy Policy. If you do not agree with or are not comfortable with any aspect of this Privacy Policy, you should immediately discontinue access or use of WAGENCY.

CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time. If we make any material changes, we will notify you by email (sent to the e-mail address specified in your account) and/or by means of a notice on the Website prior to the change becoming effective. By continuing to use WAGENCY Services, you will be deemed as having accepted modifications to the Privacy Policy.

OUR RELATIONSHIP TO YOU (“WAGENTS”)

Working Artists and the Greater Economy, Inc. (185 Ocean Avenue, Brooklyn, NY 11225) is a 501c3 nonprofit organization founded in 2008. The mission of W.A.G.E. is to establish sustainable economic relationships between artists and the institutions that contract artists’ labor, and to introduce mechanisms for self-regulation into the art field that collectively bring about a more equitable distribution of its economy. WAGENCY is a program of W.A.G.E. WAGENCY is a transactional platform that provides working artists of varying means with the necessary collective agency to negotiate compensation or withhold content from the nonprofit institutions that contract artists’ labor. WAGENCY allows WAGENTS to initiate fee requests from Contracting Institutions and to negotiate with reference to W.A.G.E. standards, as well as to keep a record of all requests, negotiations and outcomes. WAGENCY does not collect or enforce payments.

We distinguish between personal data that can be traced to you such as your name, e-mail address, billing information, etc, and the data generated through your use of WAGENCY’s Services, which is anonymized and aggregated to help us keep track of the way WAGENCY is used and the impact that it is having on the art field.

We will never share your personal data with third parties unless required to do so by law or subject to your consent while you still have an Account, regardless of whether you are a Paying User or not. Once you delete your Account, we do not retain your data.

We collect anonymized data of your use of the platform with the primary purposes of gauging WAGENCY's impact on the art field and strengthening WAGENTS’ negotiating power. The aggregated data is used to produce reports, some of which may be publicly accessible. We believe that a report can function as an important tool in bringing about a more equitable distribution of art’s economy. We may add information to the report through additional questions sent out to WAGENTS, which you are free to respond to or ignore.

We collect the following types of anonymized information:

  • the number of payments that are initiated through WAGENCY;

  • the average number of fee requests initiated through WAGENCY;

  • the mean number of payments made above, at, and below W.A.G.E. standards;

  • the average amount of time it takes WAGENTS to receive payment;

  • the geographical spread of WAGENTS;

  • the geographical spread of Contracting Institutions.

We reserve the right to modify this list if it becomes evident that other kinds of information would be beneficial to WAGENCY and in fulfilling W.A.G.E.’s mission. As previously stated, you will be notified of any such changes and given the opportunity to either consent or reject.

As WAGENCY is a platform for collectivizing leverage, we require that WAGENTS agree to have their name, city, country, and membership number listed on a publicly accessible page of the W.A.G.E. Website.

HOW YOUR INFORMATION IS USED

Our main purposes in collecting information are to provide you with a secure, smooth, efficient, and customized experience, and to gather anonymized data that will help strengthen WAGENCY as a platform for collectivizing leverage. In relation to the former, please also see our Cookie Policy below. In general, we use personal information to develop, operate, deliver, and improve the WAGENCY platform. We may use this information in the following ways:

  • To provide user service;

  • To ensure quality control;

  • To ensure network and information security;

  • To enhance your platform experience.

The anonymized data is aggregated to help our analysts assess the impact WAGENCY is having on the art field through statistical trends.

Upon cancellation and deletion of your WAGENCY Account, all the recorded activity on your Account including your personal information will be immediately removed. This information cannot be recovered once your Account has been deleted.

We cannot trace or delete the data reflecting your prior usage of WAGENCY, which has been aggregated and anonymized.

HOW YOU CAN ACCESS OR CHANGE YOUR PERSONAL INFORMATION

You are entitled to review, correct, amend, or delete your personal information, or to delete that information where it is inaccurate. You may do this at any time by logging in to your account.

RETENTION OF YOUR PERSONAL INFORMATION

We store your personal information securely until you delete your WAGENCY Account. We do not retain any personal information once your Account has been deleted.

RETENTION OF THIRD PARTY PERSONAL INFORMATION

We only retain information on third parties that you may include in filling out your Fee Requests, in order for the request to remain valid throughout the negotiation process. The contact information belonging to Contracting Institutions will not be used by W.A.G.E. for any purpose except to deliver Fee Requests and facilitate negotiations that you have initiated with Contracting Institutions. When you delete your account, this information is not retained.

CUSTOMIZED FEE SCHEDULES

Customized Fee Schedules are generated using data from the Contracting Institution’s most recently disclosed Total Annual Operating Expenses (TAOE) on IRS Form 990. Tax-exempt organizations with gross receipts over $50,000 are required to file IRS Form 990 each year. The 990 includes publicly available information about the nonprofit's mission, programs, and finances, including its total annual operating expenses. This information is accessed directly from Candid, the world's largest source of information on nonprofit organizations. W.A.G.E. is a licensed user of Candid's API.

Functionality: cookies are used to recognize you, and to remember your preferences or settings when you return in order to provide you with a more personalized experience. For example, if you create a fee request, we will remember your requested fees and contacts to ensure that your request is saved. Only first-party cookies are used in this instance.

We also use third-party cookies to track how visitors are using our site. Our Website uses Google Analytics, a website analysis service by Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Google Analytics uses cookies and text files that are stored on your computer to analyze your use of the Website. The information generated by the cookie about your use of this website is usually sent to and stored at a Google server in the U.S.A. AGE REQUIREMENT

You have to be 18 years of age or above to register as a WAGENT. If a User submitting personal information is suspected of being younger than 18 years of age, W.A.G.E. will require the User to close his or her account. We will also take steps to delete the information as soon as possible.
